The www.bar-operadeparis.fr Site allows La Maison Villaret (hereinafter the “Seller”) to offer products for sale (hereinafter referred to as the “Products”) to Internet users browsing the Site and who have the consumer status within the meaning of the law (hereinafter referred to as «Customers»). For the application here of, it is agreed that the Customer and La Maison Villaret will be collectively referred to as the “Parties” and individually referred to as the “Party”.

Article 1 - General provisions relating to these General Conditions of Sale (hereinafter the «GTC»)

1.1. The GCS govern the rights and obligations of the Parties resulting from the online sale of the Products offered on the site, to the exclusion of any other document. 

1.2. The Customer declares to have the legal capacity allowing him to engage under the present. 

1.3. The validation of the Order is worth irrevocable adhesion of the Customer to the GCS. 

1.4. The Seller reserves the right to modify its T&Cs at any time. In the event of modification, the applicable GCS are those in force on the date of the Order. 

Article 2 - Produits

Only the Products appearing on the Site on the day of its consultation by the Customer are offered for sale. The customer who placed an order declares to have read the details, the preparation and the ingredients indicated on the site www.bar-operadeparis.fr. Maison Villaret reserves the right to modify the recipes of its drinks at any time.

Article 3 - Availability of Products

The Products are sold and delivered within the limits of available stocks. In the event of unavailability of the Product ordered, the Seller offers the Customer a Product of equivalent quality and price. Failing agreement, the Seller shall refund the sums paid within 30 days. 

Article 4 - Price 

4.1. Prices are quoted in euros all taxes included. 

4.2. The Seller reserves the right to modify its prices at any time while guaranteeing the Customer the application of the price in force on the day of the Order. 

Article 5 - Order 

5.1. Registration of the Order

To place an Order, the Customer must:

. Select the performance hall as well as the performance date of the Client’s visit;

. Indicate the products selected and the quantities desired;

. Provide the information relating to ordering as a guest or creating an account and the method of payment.

Before confirming the Order, the Customer has the possibility to check the details of his Order, its total price, and to return to the previous pages to correct any errors or modify his Order. 

5.2. Confirmation of the order

The sales contract is formed at the time of sending the validation of his Order by the Customer who declares to have read the GCS and to accept them irrevocably. It is recalled that the Seller reserves the right to refuse any order for legitimate reasons and without limitation, for the following reasons:

– Refusal of payment authorization from banking institutions;

– Failure to pay for the Order;

– The quantities of Products ordered are abnormally high for Customers with consumer status. As such, the assessment of the abnormally high nature of the Products ordered is left to the sole discretion of the Seller.

5.3. Payment

The price is immediately payable after validation of the Order. Payment is made in euros by credit card, the Mollie system ensuring the protection of bank data. 

5.4. Summary

At the end of the payment, the Seller sends the Customer a Purchase Order by e-mail to the address indicated. This document containing all the constituent elements of the contract entered into between the Parties, is kept by the Seller on a reliable and durable medium. 

Article 6 – Pick up of the products 

6.1. General

The Customer undertakes to withdraw the Product(s) according to the procedure indicated to him on the validation sent by e-mail.

The Product(s) must imperatively be collected on the date chosen by the Customer and indicated on the validation sent by e-mail. If the Product(s) are not collected on the date indicated, the Seller’s liability cannot be engaged and no refund will be due except in the event of cancellation of the performance. 

6.2. Pick up of the command

The risk of loss or damage to the Products is transferred to the Customer upon withdrawal of his Order. It is his responsibility to verify the conformity of the Products. Any anomaly must be notified immediately to the Seller’s representative on site. 

Article 8 - Responsability 

8.1. General

It is recalled that the choice and purchase of Product(s) are placed under the sole responsibility of the Customer. The Products offered for sale comply with the French legislation in force.

The Seller cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion, the presence of a computer virus or any other disturbances in the use of the Site. implying or not the impossibility of accessing it and/or ordering.

These GCS are subject to French law. Any dispute between the Seller and the Customer will be subject to the sole jurisdiction of the French courts.
